Terms of Service – Hebrew Hayom (English / International Version)

1. Acceptance of Terms By accessing or using the Hebrew Hayom website, creating an account, registering for lessons, or purchasing any services or digital content, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.

2. Services Provided Hebrew Hayom offers Hebrew language learning services and materials, including:

  • Live private (1-on-1) lessons via Zoom/Google Meet or similar platforms.

  • Live group courses, workshops, or cohorts via Zoom.

  • Digital content: pre-recorded video courses, downloadable PDFs, worksheets, and other materials.

3. Pricing, Payments & Taxes

  • Prices are displayed in [NIS / USD] (as indicated at checkout).

  • For Israeli customers: VAT (Ma'am) is included where applicable; a tax invoice (Heshbonit Mas) will be issued automatically.

  • For international customers: You are solely responsible for any local taxes, customs duties, bank fees, currency conversion charges, or other costs. All payments are processed securely in the displayed currency.

4. Cancellation & Refund Policy This policy complies with the Israeli Consumer Protection Law, 5741-1981 (including distance selling regulations and Amendment 47). Statutory rights prevail if they provide greater protection.

4.1 Digital Content (Pre-recorded Videos, PDFs, Downloads, etc.) Digital content is considered "information" or recordable/reproducible goods excluded from statutory cancellation rights under the law. Once access is granted (e.g., login credentials provided, streaming begins, or download occurs), the sale is final and non-refundable, except in cases of a material technical defect that we cannot resolve within a reasonable time.

4.2 Private 1-on-1 Live Lessons

  • You may cancel or reschedule free of charge with at least 24 hours' advance notice.

  • Cancellations with less than 24 hours' notice or no-shows will be charged in full; no refunds or makeup lessons will be provided (subject to any overriding mandatory statutory right).

4.3 Live Group Courses / Workshops / Cohorts

  • General distance cancellation right: You may cancel within 14 days from the transaction date or receipt of the required disclosure document (whichever is later).

  • For non-continuous services (e.g., scheduled group start date): Cancellation must be received at least 2 non-rest days (ימי מנוחה – typically Friday/Saturday) before the course start.

  • Valid cancellation fee: The lesser of 5% of the price or NIS 100.

  • Refunds (after fee) will be processed within 14 days of receiving valid notice.

  • After the course has started: No refunds, unless the service qualifies as ongoing/continuous under law — in which case you pay pro-rated value for the delivered portion, and the remainder is refunded (if applicable).

4.4 Protected / Special Populations If you qualify as a senior citizen (65+), person with a disability, or new immigrant (Olim Chadashim – generally within 5 years from receiving Oleh visa/eligibility certificate), you may cancel a qualifying distance transaction within 4 months from the transaction date, receipt of the product/content, or receipt of the disclosure document (whichever is later), provided the transaction included a "dialogue" between us (including electronic means such as email, chat, confirmation messages, or Zoom communication).

  • We may request proof of status (e.g., ID for age, relevant certificate, Te'udat Oleh/eligibility document — electronic copy acceptable).

  • Timing restrictions still apply (e.g., ≥2 non-rest days before start for non-continuous services).

  • This extended right does not override the digital content exclusion once access is granted.

  • Cancellation fees and refund timing as detailed above.

4.5 How to Cancel Send written notice to support@hebrewhayom.com (recommended for records) or use any cancellation form/link provided on the site. We will process in accordance with applicable law.

5. Intellectual Property & Usage Restrictions All content (videos, methods, PDFs, worksheets, live sessions) is owned by Hebrew Hayom or its licensors. You are granted a limited, personal, non-transferable, revocable license for your individual learning purposes only. You may not record, copy, share, distribute, reproduce, sell, or publicly display any materials or sessions. Violations may result in immediate termination of access (without refund where permitted) and potential legal action.

6. Limitation of Liability & Disclaimer To the maximum extent permitted by law:

  • Hebrew Hayom is not liable for indirect, incidental, consequential, or punitive damages (including lost profits, learning outcomes, or data loss).

  • Total liability for any claim is limited to the amount you actually paid for the specific service/product in question. Services are provided "as is" without warranties of any kind.

7. Privacy We collect and process personal data only as necessary for account management, service delivery, payments, and support. We do not sell personal data. Data may be shared with essential providers (e.g., payment processors, Zoom) under strict safeguards. Your data is processed in Israel. 8. Governing Law & Jurisdiction These Terms are governed exclusively by the laws of the State of Israel. Any disputes shall be resolved in the competent courts of Tel Aviv-Yafo, Israel (unless mandatory consumer protection rules require otherwise).

9. Changes to Terms We may update these Terms from time to time. The current version (with effective date) will be posted here. Continued use after changes constitutes acceptance.

Use this for the Cancellation & Protected Populations parts (translate/mirror the rest accordingly):

מדיניות ביטול והחזרים (עסקאות מכר מרחוק) תוכן דיגיטלי (סרטונים מוקלטים, קבצי PDF, הורדות וכד'): תוכן דיגיטלי נחשב "מידע" או טובין ניתנים להקלטה/שכפול, ולכן מוחרג מזכות ביטול לאחר מתן גישה (מתן פרטי התחברות, התחלת צפייה או הורדה). העסקה סופית, למעט תקלה טכנית מהותית שלא נפתרה בזמן סביר.

שיעורים פרטיים (1-על-1 בזום): ביטול/דחייה ללא תשלום עד 24 שעות מראש. ביטול מאוחר או אי-הגעה – חיוב מלא, ללא החזר/השלמה (בכפוף לזכויות קוגנטיות).

קורסים/סדנאות קבוצתיות חיות: זכות ביטול כללית: בתוך 14 ימים ממועד העסקה או קבלת מסמך הגילוי (המאוחר). לשירות לא מתמשך (תאריך התחלה קבוע): הודעה לפחות שני ימי מנוחה לפני ההתחלה. דמי ביטול: המינימום מבין 5% או 100 ₪. החזר בתוך 14 ימים. לאחר התחלה: אין החזרים, אלא אם שירות מתמשך – תשלום יחסי על החלק שניתן.

אוכלוסיות מוגנות (אזרח ותיק 65+, אדם עם מוגבלות, עולה חדש): זכאות לביטול בתוך 4 חודשים (ממועד העסקה/קבלת הנכס/מסמך גילוי – המאוחר), בתנאי שהתקיימה שיחה בין העוסק לצרכן (כולל תקשורת אלקטרונית כגון דוא"ל, צ'אט או אישור זום). רשאים לדרוש הוכחת סטטוס (ת.ז., תעודת עולה וכד' – העתק אלקטרוני בסדר). הגבלות זמן חלות (למשל 2 ימי מנוחה לפני התחלה). אין גובר על החרגת תוכן דיגיטלי לאחר גישה.
