Terms of Use – Hebrew Hayom (English / International)

1) Acceptance

By accessing this website, creating an account, or purchasing any product or service, you agree to these Terms.

2) What We Provide

Hebrew Hayom provides Hebrew learning services and materials, including:

• Live Sessions: private (1-on-1) and group lessons via Zoom/Google Meet (or similar).

• Digital Content: pre-recorded video courses and downloadable materials (PDFs, worksheets, etc.).

3) Pricing, Payments, Taxes

• Prices are shown in [NIS / USD] unless stated otherwise.

• Israeli customers: VAT will be charged where applicable and a tax invoice/receipt will be issued.

• International customers: you are responsible for any local taxes, bank/FX fees, and import/digital taxes where applicable.

4) Cancellation & Refund Policy (Statutory Rights + Our Scheduling Rules)

These policies are intended to comply with the Israeli Consumer Protection Law, 5741-1981 and related rules for distance transactions. Where mandatory law grants you additional rights, those rights remain. 

4.1 Digital Courses & Downloads (Digital Content)

Digital content may be treated as “information” / content excluded from statutory cancellation rights in distance transactions. Once access is provided (e.g., login credentials, streaming access, or download delivery), the sale is final, except where there is a material technical defect we cannot resolve within a reasonable time. 

4.2 Private Lessons (1-on-1 Live Sessions) — Scheduling Policy

• Reschedule / cancel free of charge with at least 24 hours’ notice.

• Late cancellation (<24 hours) or no-show: the session is charged in full; no refund or makeup.

• If a statutory cancellation right applies to your purchase (for example, where a distance-transaction cancellation is valid), we will apply it. 

4.3 Live Group Courses / Workshops (Zoom, live cohorts)

Distance-transaction cancellation (general rule): you may cancel a service purchase within 14 days from the transaction date or from receiving the legally required transaction/disclosure document (whichever is later). For a non-continuous service, cancellation must be made at least 2 non-rest days before the scheduled start date. 

Fees & refunds:

• For a valid cancellation not due to our breach/defect, we may charge a cancellation fee equal to the lesser of 5% of the price or NIS 100. 

• Refunds are processed within 14 days from receiving a valid cancellation notice. 

If the course/service has started:
If the transaction qualifies as an ongoing service and you cancel within a valid statutory window after service has begun, you will pay the proportional value for the part already provided, and the remainder (if any) will be refunded per law. 
If you cancel outside the statutory window or in a way that does not meet the timing rules above, no refund is due.

4.4 Protected / Special Populations (Senior Citizens, Persons with Disabilities, New Immigrants)

If you are a senior citizen (65+), a person with a disability, or a new immigrant (generally, within 5 years from issuance of an immigrant certificate / eligibility certificate), you may cancel a qualifying distance transaction within 4 months (from the transaction date / receipt of the product / receipt of the disclosure document—whichever is later), provided that the transaction included a “dialogue” (including email/chat/other electronic communication). 

• We may request proof of status (e.g., ID for age, relevant disability certificate, Te’udat Ole / eligibility certificate) and you may provide it as a copy electronically. 

• For services, the timing restriction still applies (e.g., for non-continuous services: at least 2 non-rest days before the service date). 

• This does not override statutory exclusions for digital content treated as “information” / excluded content once access has been provided. 

• Refund timing and cancellation fee rules apply as above. 

4.5 How to Cancel

You can cancel by:

• Emailing [support@hebrewhayom.com], and/or

• Using a cancellation link/form on our website (where available).

We recommend written notice for clarity, but we will handle cancellations in accordance with applicable law. 

5) Intellectual Property & Usage Restrictions

All videos, PDFs, texts, slides, and course materials are owned by Hebrew Hayom and/or licensors. You receive a personal, non-transferable, revocable license for individual learning only.
You may not copy, record, redistribute, sell, sublicense, or publicly share any materials or live sessions. We may terminate access for violations (including without refund where legally permitted).

6) Disclaimer & Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.

• Our total liability for any claim is capped at the amount you paid for the specific product/service giving rise to the claim.

7) Privacy (Short Form)

We process personal data for account management, service delivery, payments, and support. We do not sell personal data. We share data only with necessary service providers (e.g., payment processors) under appropriate safeguards.

8) Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Israel. Courts in Tel Aviv-Yafo will generally have jurisdiction, unless mandatory consumer-protection rules require otherwise.

9) Changes

We may update these Terms from time to time. The updated version will be posted on the website with a revised effective date.

Hebrew (Legally Sensitive Section Only): ביטול עסקה + אוכלוסיות מיוחדות

מדיניות ביטול והחזרים (עסקאות מכר מרחוק)
מדיניות זו נועדה לעמוד בהוראות חוק הגנת הצרכן, תשמ״א-1981 והדינים הנלווים בנוגע לעסקת מכר מרחוק. 

תוכן דיגיטלי (קורסים מוקלטים/קבצים להורדה):
תוכן דיגיטלי עשוי להיחשב “מידע”/תוכן שמוחרג מזכות ביטול בעסקאות מכר מרחוק. לאחר שניתנה גישה (שם משתמש/סיסמה, צפייה/הזרמה, או הורדה), העסקה סופית, למעט תקלה טכנית מהותית שלא נוכל לפתור בתוך זמן סביר. 

שיעורים פרטיים (1-על-1 בזום) – מדיניות תיאומים:
ביטול/דחייה ללא עלות עד 24 שעות מראש.
ביטול מאוחר (פחות מ-24 שעות) או אי-הגעה: חיוב מלא, ללא החזר/שיעור השלמה, בכפוף להוראות דין קוגנטיות אם חלות. 

קורסים/סדנאות קבוצתיות בשידור חי (זום):
ניתן לבטל בתוך 14 ימים ממועד העסקה או ממועד קבלת מסמך הגילוי/סיכום העסקה (לפי המאוחר). לגבי שירות שאינו מתמשך, הביטול מותנה בכך שהודעת הביטול תימסר לפחות שני ימים שאינם ימי מנוחה לפני מועד תחילת השירות. 
דמי ביטול: עד 5% או 100 ₪ (הנמוך מביניהם), אלא אם הביטול נובע מפגם/הפרה מצד העוסק. 
החזר כספי: בתוך 14 ימים ממועד קבלת הודעת ביטול תקפה. 
אם החל מתן השירות בעסקה מתמשכת ובוצע ביטול במסגרת חלון ביטול תקף – הצרכן ישלם תמורה יחסית עבור החלק שניתן, ויקבל החזר על היתרה (אם קיימת), בהתאם לדין. 

אוכלוסיות מיוחדות (אזרח ותיק/אדם עם מוגבלות/עולה חדש):
אזרח ותיק (65+), אדם עם מוגבלות, או עולה חדש (ככלל עד 5 שנים ממועד הנפקת תעודת עולה/תעודת זכאות) רשאים לבטל עסקת מכר מרחוק בתוך 4 חודשים (ממועד העסקה/קבלת הנכס/קבלת מסמך הגילוי – לפי המאוחר), ובתנאי שהייתה “שיחה” בין העוסק לצרכן (כולל צ’אט/מייל/תקשורת אלקטרונית). 
העוסק רשאי לדרוש מסמך להוכחת סטטוס (למשל ת״ז/תעודת עולה/אישור רלוונטי), וניתן להעבירו גם באמצעים אלקטרוניים. 
הוראות אלה אינן גוברות על החרגות דין לגבי תוכן דיגיטלי/“מידע” לאחר מתן גישה. 

דרך ביטול: ניתן לשלוח הודעת ביטול בדוא״ל ל-[הכנס/י אימייל], ובמקום שבו קיים באתר – באמצעות קישור/טופס ביטול. מומלץ לשמור תיעוד.
